TERMS AND CONDITIONS

Object and Organization

These contractual terms and conditions are intended to establish the terms and conditions governing the provision of travel services organized by OUT COME OUT (by Artur Jorge da Silva Inácio), based at Beco Miguel Torga, 1, Bloco C, 2 Esq, in Albufeira, ENI with NIF 219450161, RNAVT Registration No. 10599, between the Agency and the Client.

The organization of the Tours is the responsibility of the OUT COME OUT Travel Agency (by Artur Jorge da Silva Inácio), referred to in these Terms and Conditions in this way either by Agency or by OUT COME OUT.

These Terms and Conditions of participation are complemented by the Travel Itinerary in which the Client subscribes, which constitutes the Particular Conditions for participation in the Tour.

When contracting with the Agency, the Client acknowledges and accepts all the Terms and Conditions established as well as the Privacy Policy.

These Terms form the agreement under which you will use our Website and we will supply our Tours to you. Please read these Terms carefully. Your use of our Website or booking or participation in a Tour, indicates that you have sufficient opportunity to access these Terms and Conditions and the Privacy Policy, and that you have read, accepted and will comply with these Terms. If you have any questions, please contact us before using our Website or booking or participating in a Tour, by using the contact details.

Responsibility

The Agency's liability is guaranteed by civil liability insurance in the insurance company Ageas and by the Travel and Tourism Guarantee Fund of Turismo de Portugal, under the terms of the legislation in force in Portugal and the European Community.

Reservations and Payments

The booking of a Tour made by the Client and his companions starts by filling out a form on the page of the intended Tour, in which the Client confirms to accept the Agency's Terms and Conditions and Privacy Policy.

The Agency may, at our discretion, accept or reject any booking of a Tour, for any reason.

After sending this form, and if OUT COME OUT accept your booking, the Agency will respond via email with the details of the Tour, asking for other necessary data and also asking for the payment of a deposit or the total amount of the Tour.

It is the Client's responsibility to verify all the information contained in the email sent by the Agency, namely the reservation and Tour details, before making the payment.

The reservation is only confirmed after payment of a deposit of €500 or full payment.

If the reservation is made 60 days or less before the start of the Tour, the total price of the Tour must be paid at the time of booking.

For the payment of the deposit or the full payment, the Client will receive another email and has 7 days to make the payment. OUT COME OUT reserves the right to cancel any reservation request whose payment has not been made under the aforementioned conditions.

After payment confirmation, the Client will receive a new email from OUT COME OUT confirming the reservation and with the Tour details and other relevant information.

For any Tour organized by OUT COME OUT there is a minimum amount of 4 participants for it to take place. Only after the confirmation by OUT COME OUT to the Client that there is a minimum number of participants is the Tour confirmed.

When booking a Tour, the Client assumes several commitments to OUT COME OUT:

- Having become aware of and accepting these Terms and Conditions, as well as the Tour itinerary in which the Client subscribes, which constitute the particular conditions for participating in the trip.

- You are in adequate health conditions for the trip in which you are enrolled and accepts the nature of the same trip, namely the risks arising from the impossibility of immediate access to medical assistance.

- That you are aware of the type of physical, cultural and psychological demands that the trip may involve and that may lead to unforeseen situations.

Minimum age

The minimum age to participate in OUT COME OUT Tours is 18 years old.

Documentation

The customer is responsible for any and all personal or family documentation (identity card, passport, visas, vaccination certificates and others that may be required) necessary for the Tour. The Agency declines any responsibility for the refusal to grant visas or the refusal to allow the Client to enter a foreign country. In these cases, the conditions established in the clause “Cancellation by the Customer” apply, and the Client is also responsible for any and all costs that such situation entails.

Language spoken during travel

It is a fundamental condition that the Customer speaks English in order to participate in one of the OUT COME OUT Tours. Although the Host/Tour Leaders are Portuguese, since the Clients are of different nationalities, the English language will be the form of communication in all tours and visits included in the itinerary.

Accommodation

OUT COME OUT has rooms for two people as accommodation for your trips. In some cases, when mentioned in the Tour itinerary, accommodation may be in triple rooms or for more people, dormitories, camping tents, beds in train cabins or others.

OUT COME OUT will group in pairs (or in another number if the accommodation is not for two people), by sex, customers who register individually for the same trip. On some trips, due to the characteristics of each accommodation, separation by gender may not be possible.

Privacy and use of Client information

The Client gives express consent for all information, including personal data, provided in relation to his Tour to be transmitted to government authorities for the purpose of border control and security in air travel or other.

The Client gives express consent so that all information, including personal data, provided in relation to his Tour may be transmitted to OUT COME OUT's local partners in order to be able to carry out the Tour itinerary, including tastes, food preferences, particular information about health or others.

OUT COME OUT will make the necessary contacts with the customer, in order to guarantee the proper functioning of the service.

Meeting place and start of Tours

The meeting place of the Client, his companions on each Tour with the Host/Tour Leader and with the other participants is indicated in each Tour itinerary. The specific place will be communicated to the Customer in a timely manner before the start of the Tour.

It is the responsibility of the Client to purchase air travel, or other means of transport, which takes him and his companions to the place where the Tour begins. It is also the Client's responsibility to be at the meeting point at the time indicated for the start of the Tour.

Tailor-Made Vacations

The Client fill in the form with the information OUT COME OUT needs, to find out if it's possible to organize what the Client wants.

If possible, the Agency will contact the Client to clarify any questions that may arise so that it's possible to design the itinerary.

If the Client agree to proceed:

- OUT COME OUT will charge a planning fee of €200 per guest for itineraries of up to 14 days.

- For itineraries longer than 14 days, OUT COME OUT will indicate the value depending on the number of days.

After payment, OUT COME OUT will send by email a suggestion of itinerary, activities and tours and also accommodation, based on the Clients interests.

If approved by the Client, OUT COME OUT will start budgeting a complete day-by-day itinerary, with its inclusions and booking conditions.

After the Client receive this complete itinerary and the budget, and agree with it, the Client can still make a request for revision/changes that consider important. If further revisions are required, OUT COME OUT will ask for an additional planning fee of €100 per guest to proceed.

After the Client confirming and accepting the itinerary, the reservation is created. Payment of the budget amount must be made, deducting 50% of the planning fees paid. After payment, OUT COME OUT will book the hotel, activities, tours, guides and anything else applicable.

OUT COME OUT will provide to the Client all the necessary/important information for the trip such as mandatory visas, vaccinations, etc. In the meantime, up to 3 weeks before the start date of the trip, the Agency may send some information that may be of interest.

3 weeks before the Client departure, OUT COME OUT will send the final Travel Documents including detailed itinerary, contact details of guides/others, among other recommendations.

Change of dates

The Client registered for a Tour cannot change his registration for another Tour or for the same Tour departing on a different date without the express consent of OUT COME OUT. If it is possible to make such a change, it may be subject to expenses and charges.

Change of participants

The Client may assign his reservation, being replaced by another person who fulfills all the conditions required for the Tour, provided that he informs the Agency at least 60 days in advance of the departure date and that the different service providers of the Tour accept the replacement, under penalty of being considered that the Client has given up the Tour. If the Client intends to transfer his registration to a person of a different sex, he may be subject to the payment of the individual accommodation supplement for the Tour or to a cost of the same nature if this is not foreseen for the Tour in which he has registered, in the case of it is not possible to group the new participant with another person of the same sex.

The assignment of registration is jointly and severally liable for the payment of the price of the trip and for the additional charges arising.

However, we will be under no obligation to make such a participant change and such permission will be at our discretion.

Changes

Whenever there are external reasons that justify it, the Agency may change the routes, the order of the routes, modify the departure times or replace any of the accommodation or transport provided by others of a similar category and location.

The Tour itinerary may be subject to change due to unexpected circumstances or events. If we are unable to offer a particular inclusion in the Tour itinerary due to events or circumstances beyond our reasonable control, we will use our best endeavors to replace it with an inclusion of equal or greater value.

Minimum number of participants and Tour cancellation by the Agency

The Tour itinerary will establish, on a case-by-case basis, the minimum number of participants. If the minimum number of participants is not reached, the Agency may cancel the Tour and will inform the customer in writing via email of the cancellation up to 20 days before the departure date, refunding the Customer of all amounts paid, leaving the Agency released from any liability for cancellation or payment of any compensation.

We will notify you as soon as possible if we need to suspend or reschedule a Tour because of events or circumstances beyond our reasonable control, the Client being reimbursed for all amounts paid, the Agency being exonerated from any liability for the cancellation or payment of any compensation.

​In case of cancellation, OUT COME OUT does not accept any responsibility for services purchased by the Client from third parties such as flights, equipment or others.

Client cancellation

If the Client wishes to cancel the Group Tour reservation, he must do so in writing to the Agency's email and the following cancellation terms will apply:

- Up to 60 days before the departure date, we will keep the deposit amount paid as credit, minus sunk costs and a cancellation fee of €150 per traveller. If you have paid more than the minimum deposit amount, we will refund any amount in addition to your deposit.

- Between 59 and 30 days before the departure date, the Agency keeps 50% of the total amount paid by the Client as a cancellation fee and the remaining 50% is retained as credit for a future Tour.

- Less than 30 days before the departure date, the Agency keeps 100% of the total payment made by the Client as a cancellation fee, with no refund or credit.

We advise the Client to have a travel insurance with the cancellation option.

Refunds

Once the Tour has started, no refund is due for services not used by the Client. Failure to provide services indicated in the Tour itinerary for reasons not attributable to the Agency and if replacement by other equivalents is not possible, entitles the Client to be reimbursed for the difference between the price of the services provided and that of those actually provided.

Price changes

The prices indicated in each Tour are based on the costs of services and exchange rates in force on the date of publication, so they may be subject to changes resulting from variations in the cost of transport or fuel, duties, taxes, fees and exchange rate fluctuations.

Whenever there is a change in the price of the Tour, the Client will be immediately informed and invited to, within the period set for him, accept the increase verified or cancel his registration.

VAT

All prices indicated on the Agency's website already reflect the Value Added Tax (IVA) at the current rate.

Travel insurance

The Client is obliged to purchase travel insurance. The insurance must be adjusted to the duration of your Tour, destination and type of activities. By not subscribing to travel insurance or purchasing inappropriate travel insurance, the Client automatically exempts OUT COME OUT and all its service provider partners from any liability relating to the risks and consequent costs that the Client incurs for not having performed the protection requested and reported as mandatory.

You will need to provide us with proof that you have travel insurance. Your travel insurance must include medical assistance and repatriation in case of illness or accident and must clearly and comprehensively cover all expenses arising from the Covid19 pandemic. Only by fulfilling this requirement will you be able to participate in the Tour.

Travel insurance with a cancellation option is not mandatory but recommended.

Complaints

Complaints can only be considered as long as they are presented in writing within a period not exceeding 20 days after the end of the provision of services. They can only be accepted as long as they have been reported to the service providers (hotels, guides, local agents, etc.) during the course of the Tour or stay, requiring from them the respective documents proving the occurrence.

Any conflict arising from this service provision contract will be settled by the Judicial Court of the District of Albufeira (Portugal), with express waiver of any other and for all matters not regulated by these Terms and Conditions of Participation, Portuguese Law will apply.

Private Tours

Private Tours are subject to the same Terms and Conditions as regular Group Tours.

Open Date Trips

To reserve this service, the total amount must be paid at the time of booking.

A PDF with the itinerary and all bookings made on behalf of the Client will be sent to the Client.

After payment, if the Client wishes to cancel, for an Open Date Trip reservation, no refund will be issued.

Gift Cards

Customers can purchase Gift Cards on the Out Come Out website.

When purchasing a Gift Card, the customer will receive a code by email that they can use to discount when booking a gay group tour.

- After purchase, the gift card code will be sent to the registered email address

- The use of the gift card code cannot be combined with other promotions, promo codes, discounts, etc.

- The gift card is valid for one year

- The gift card can only be used on gay group tours and the value of the tour must be higher than the value of the gift card

- The gift card can be used by the customer or given to someone else

- The gift card code can only be used once

Baggage

The Agency is not responsible, under any circumstances, for the luggage and other belongings that the Client and his/her companions carry with them, regardless of the location or means of transport used. The Client is recommended to contract luggage insurance and to be present in the loading and unloading operations of the same. In case of removal, deterioration or destruction of luggage, the Client and his/her companions must complain immediately, in writing, to the service provider and/or entity in whose custody they were deposited, keeping a copy of the complaint. The Agency's liability can only be activated upon presentation of proof of the claim provided for in the previous paragraph.

Client conduct

All Clients, when participating in a Tour organized by OUT COME OUT, must always cooperate with the Host/Tour Leader and must behave in an appropriate, non-aggressive, respectful and decent, non-intimidating and appropriate manner, always complying with the law. Client must follow these Terms and comply with any instructions given by the Host/Tour Leader or any of the local tour guides at all times.

If the Client's conduct is inappropriate, we may ask the Client to leave the Tour without any right to reimbursement or compensation on the part of OUT COME OUT.

Client agrees and acknowledges that we cannot control the conduct of Client and any third party and that to the fullest extent permitted by law, we will not be responsible for any conduct of Client or any third party.

Client cooperation

In order for us to process the booking for the Tour and provide the same Tour to the Client, the Client agrees to cooperate and provide all necessary information and documentation reasonably required by OUT COME OUT. This includes, and is not limited to, indicating the full name, date of birth, passport and passport data and/or other details necessary for the correct and complete realization of the Tour. All information provided by the Client must be correct and complete.

Photos and Videos

During all days of the Tour, the Host/Tour Leader or other members of the Tour group can take photos or record videos in which the image of the Client participating appears or, the Client can provide OUT COME OUT with photos and videos that he has recorded. The Client authorizes the Agency to publish such photos and videos (including the name, location and date) for marketing purposes, including the website and social media.

Note

These Terms and Conditions are complemented by the Tour itinerary in which the Client and his/her companions sign up, which constitute the particular conditions for participating in the Tour. They may also be complemented by any other specific conditions sent to the Client at the time of registration or any others as long as they are duly agreed by the parties.
